Collective Licensing of Extended Effect

GRANTING OF COLLECTIVE LICENSES WITH AN EXTENDED EFFECT IN RELATION TO THE USE OF MUSICAL WORKS BY TV AND RADIO STATIONS AS WELL AS BY PROVIDERS OF SUBSCRIPTION TV SERVICES WITHIN THE GREEK TERRITORY

This statement is posted on the Organization's website in accordance with Article 7A of Law 4481/2017 and concerns the possibility and intention of the Organization to grant, along with the other Collective Management Organization of music copyright in Greece, collective licenses with an extended effect to television and radio stations, as well as to providers of subscription television services, which may cover the period from 1.1.2023 onwards:

AUTODIA, as a sufficiently representative Collective Management Organization (CMO) of rightsholders of musical works in Greece, declares that it can grant, by its declaration to the user, which it will proceed with the other CMO of music copyright in Greece, according to Article 7A par. 2 of Law 4481/2017), the above music users collective licenses with an extended effect, in accordance with Article 7A of Law 4481/2017 (as added by Law 4996/2022), representing not only the rightsholders who have entrusted it with the management and protection of their rights, either by virtue of assignment contracts or by virtue of reciprocal representation agreements with foreign Collective Management Organizations, but all rightsholders of musical works for use in the Greek territory, who have not assigned the management and protection of their rights neither in AUTODIA, nor in the other CMO of music copyright in Greece, given that AUTODIA meets all the conditions of the law (article 7A par. 1 Law 4481/2017). Specifically: a) AUTODIA is a sufficiently representative, within the meaning of the law, Collective Copyright Management Organization of the rightsholders of musical works in Greece, b) the interests of the rightsholders are ensured, as provided for in the law, and in particular the equal treatment of all rightsholders, among other things in relation to the conditions of the license and their possibility to assign or not to different collective management organizations in whole or in part the management of certain powers or certain of their works or objects-matters of their protection, c) by the nature of the intended uses, projects or objects-matters of protection, the obtaining of the license by rightsholders on an individual basis is typically onerous and impractical, i.e. it could not cover all the rightsholders involved, d) the publicity measures provided under sections k), ka) and kb) of paragraph 1 of Article 28 are met., i.e. AUTODIA has published on its website the possibility of the Organization to grant licenses for the use of works or other objects-matters of protection by virtue of the representative power, which is provided for in Article 7A, as well as the right of the rightholder who has not assigned the management in the organization to exclude from the representative authority of the Organization, any of its works or other objects-matters of protection or uses thereof with a written or electronic declaration to it (declaration of opposition), which entails the proportional application of article 12 par. 2 of the N 4481/2017. The said provision provides for the validity of the right of the rightsholders to terminate the contract of assignment in whole or in part with respect to the property right or categories of powers, or types of works, or objects-matters of protection of their choice for the territories of their choice, or to revoke any of the rights, categories of powers or types of works and objects-matters of protection by the collective management organization, after a three(3)-month written notice, i.e. the termination takes effect three months after the written notice has been given, and the authorizations granted prior to the termination shall continue to be valid until the end of their term. Correspondingly, the above declaration of opposition takes effect three (3) months after its submission, while the collective licenses with extended effect granted, up to the said date of effect of the declaration of opposition, are not affected until the end of the initial or by extension of their term. The declaration of objection is valid per covered period or per period of music use regardless of the licensing date and must be sent both to AUTODIA and to the other CMO of music copyright in Greece.

The declaration of opposition can be sent either by post with proof of receipt to the address of AUTODIA’s head office (3, Sabbagh - Khoury Str., Marousi Attica 15125) or electronically to the address [email protected].  AUTODIA declares that the rightsholders who have not authorized it for the granting collective licenses with extended effect will have equal treatment with those who have authorized it to do so.
